Once a felon is released from prison, his opportunities of getting good jobs or pursuing a good career get limited. Such a felon feels the existence of a social boundary around him that separates him from normal people.

Section 8 of the Housing Act of 1937, often called section 8. The Housing Choice Voucher program provides tenant- based rental assistance, so that a tenant can move from one unit of at least minimum housing quality to another. However, landlords are not expected to participate in the voucher program. Most states do not allow landlords to discriminate based on the law. 

The amount of the voucher depends on the city or country, size and other factors. 

The Housing Choice Voucher Program is majorly the federal government’s program for assisting the low income families, disabled and elderly. 

The participant is free to choose any housing that meets the requirements of the program. Housing Choice Vouchers are given locally by public housing agencies (PHA). They receive funds from the U.S Department of Housing and Urban Development (HUD) to administer the voucher program.

If A Felon Can Live In A Public Housing

A convicted Felon can live in public housing, if only they meet up to the necessary requirements for application. Applicants must be 18 years and also a citizen or non citizen, and there must also be a background check. In case if you’re a US citizen, you must have valid immigration eligibility.

When a landlord’s rental decisions are not consistent, especially when refusing potential tenants from any of the protections detailed in the Fair Housing Act, it can be considered a case of intentional discrimination. In this way, a refusal to rent because of a past felony charge can be shown to be because of a discriminatory reason instead.

The unintentional discrimination helps to insure that the landlord isn’t unfairly discriminating against any felon due to their criminal history. HUD uses a three-step process to help determine if a landlord has unintentionally discriminated against a potential tenant. The process is:

• Does the policy have a discriminatory effect?
• Is the policy necessary to achieve a legitimate nondiscriminatory interest?
• Is there a less discriminatory alternative?

Necessary Requirement For Section 8

1. Know your rights, as well as knowing the law. 

Knowing the law and rights is also very important for a felon based on HUD. 

It is unlawful and illegal for a landlord to deny you housing based on your criminal history, although depending on how severe your case is. • Registration on sex offender registry. 

You can’t get help from section 8, If you have a crime record that requires you to register with a long life status as a sex offender.

• Production or dealing with methamphetamine in a government subsidized building. 

You can’t get help from section 8, if you have any crime history on any hard or synthetic drugs. With this, you are automatically disqualified from getting any assistance. 

Note: Even if any of your family members has been an ex-felon, your family won’t be eligible for applying for the scheme.

Can A Felon Stay With Someone That’s On Section 8

If someone already lives in a section 8 apartment, and an ex-convict or a felon wants to live with them, the current occupant of the house is expected to report the situation to the local PHA. PHA will determine whether an ex-convict is allowed to live with a section 8 occupant, based on his criminal record. 

Depending on the crime history of the felon, the person may be refused from staying with you. Guidelines must be followed appropriately. If not, you will be committing fraud. 

There are also strict guidelines you must follow, to have an unauthorized guest, if anyone who is an ex-convict wants to visit or stay at your place for a few days. 

Firstly, you must be permitted by local PHA and your landlord. 

Can One Get Section 8 Without A Job

So many felons find it difficult to get any legal employment and always have no money on them. The section 8 Housing Choice Voucher Program can still be of help in a particular situation. You can still qualify if you make less than the listed income limit for that area. Which simply means that you are eligible for a section 8. 

Having a zero(0) income qualifies under the rule, because the HUD rule states that your income must be less than 50% of the median income. 

Moreover, one has to confirm income qualification with the housing authority that you are interested in applying through as most affordable housing offices set their own income limits.

Can Felons Vote?

The actual levity of the crime determines the degree of disenfranchisement as they also vary between jurisdictions. In some jurisdictions, the disfranchisement is permanent, while in others the person’s right to vote is only suspended and returned after they have served their sentence, or completed their parole.

This adds to the weight of having a record, a mistake or situation out of your control, or that one action can cost you for the rest of your life. It was reported in 2016, that about 6.1 million individuals were disenfranchised on account of a conviction, about 2.47% of voting-age citizens. Also, in October 2020, it was estimated that about 5.1 million US citizens of voting age were disenfranchised during the 2020 presidential election on account of a felony conviction. 

They argue that by committing felonies or breaking the law; they have broken the social contract, and as such have given up their right to be part of a civil society. It is after all poor decision-making that got them into prison, so their having a say in the political decision-making process would also reflect that. 

This system has a lopsided and somewhat nonuniform verdict. This is because it is the state that gets to decide if a felony conviction determines if a felon can vote, not the federal government. This can cause a constant change as the law remains in flux as it is not federal law. An example of this lopsided state determining felony disenfranchisement is 

A person can be convicted of first-degree murder in the state of Vermont, and (s)he will retain the right to vote, even while in prison. But an individual who commits perjury in Mississippi could permanently be prohibited from voting.

What is Felony disenfranchisement?

Felony disenfranchisement can be defined as the denial or suspension of voting rights of citizens due to a felony conviction. In other words, being charged and arrested for a criminal offense. Interesting though that the system went from passing laws preventing certain demography from voting in colonial times to preventing those with criminal records from voting after constitutional amendments granted the right to vote to Black people.

States Can A Felon Vote In

I will do my best to compile a list showing a few of the states and what side they lean toward concerning felony voting… at least till it changes.

In states like Mississippi, Alabama, and Tennessee, under current law, individuals convicted of murder, or rape are not allowed to vote for the rest of their lives unless for special cases, like a situation where they get a pardon.

States like Kentucky and Iowa, when felons serve their full sentences, including parole, they then have to apply to state officials to regain their voting rights.

Florida is similar, but it differs in that felons are mandated to wait for at least five years after fully serving their sentences before they can apply to vote.

In states like Nevada, Wyoming, and Delaware, felons have to apply to regain their right to vote, but it depends majorly on how severe the crime is. 

In most states, felons convicted cannot vote while they are in prison, but they can after they are released; in places like Massachusetts and Hawaii, in states like Colorado and Connecticut, they regain their rights after they complete their parole, or when they are no longer on parole or probation; as in places like New Jersey and Texas.

California relaxed its rules a bit in 2016. Convicted felons sentenced to county jails can now vote while in custody, but if they are sentenced to a state or federal prison, it still prohibits them from voting.

States like Maine and Vermont, on the other hand, do not take away the voting rights of felons, even when they are still serving their term.

Some politicians have discussed plans to try to use an executive order to restore voting rights to felons on parole, essentially allowing them to vote when they have completed their parole.

For a more detailed list of the laws on felons’ voting rights in all the states, you can look up the ones gathered by procon.org for a better list.

Some good news though, states like Iowa have allowed some felons to take part in elections after they served their terms, and they are not the only ones, more states are getting on to re-enfranchising them. 

Florida has amended some of their laws, except for those convicted of murder or sexual offenses. On the other side of the divide some have passed a law that requires former felons to pay their outstanding court fees before they are given the right to vote. Seems right, except for the part that the fees are large and difficult for them to pay.

Advocating For The Right To Vote

Still, advocates and activists are pushing and fighting for convicts to get back their rights, pushing on the premise that everyone should have the right to vote, as it is one of the fundamental human rights that should never be taken away from anyone. They believe that since some of it was founded on replacing slavery and marginalization, it should not be allowed to exist.

When you think of the fact that millions are constantly restricted from voting, you start to question and think about the concept of democracy and the rights of the citizens. One of the scary statistics is that in 2016, more than 6 million were prohibited from voting on the grounds of felony convictions.

The courts support and uphold the law, this makes it more of an uphill battle as the state and law support the oppression and disenfranchisement of convicts. To change this will take a lot of lobbying, convincing politicians, and getting enough buzz and interest on the matter in a way that gets the society engaged and interested, more so that they rally around and begin to push for a change. 

There needs to be social awareness, a push so massive and talked about that the lawmakers have to consider changing the laws in a way that benefits everyone despite the mistakes that one may have made at one point or the other, bringing about the end of these unfair laws.

Summary

The claim and idea behind prison are to reform the convicted felon, teach them the error of their ways, and with the help of some charitable, non profit organizations that focus on reforming them and making them contributing members of society. Their actions should be reconsidered and their rights to vote returned to them. They have after all paid the price for their offense. 

We can only hope more states change their stand on this issue and allow ex-felons who have served their time to vote . Till then, voting right for felons is determined by the state a felon finds his/herself.

Do Juveniles Get Convicted Of A Felony?

It is only right to think, what if that minor or underaged (under 18 years) individual is just too extreme, willfully breaking the laws, disregarding the rules, and testing the same system that seeks to protect them? Will Uncle Sam do the unthinkable? Punish him/her for going against the rules, especially if they break the rules in ways that are extremely past what they should be capable of; ways that are shocking and cruel. Will the state treat them like adults? Do juveniles get convicted of a felony? Read on to find out.

Minors are often treated differently for a minor misdemeanor offense, that is when it is not a violent felony crime. They are charged as juveniles rather than as adults, and their case is decided in juvenile court.

What Does It Mean To Be Charged As A Juvenile?

Minors and children between the ages of six and 17, under the age of 18, are considered juveniles, so their criminal cases will begin in juvenile court. As discussed earlier, this is another tool of the state to help protect the minor; how? You may ask. Well, that is because the aim of this court is rehabilitation and helping the minor child to avoid committing another crime in the future. A sort of straightening the minor up and setting them down the right path, they get a taste of the justice system and learn that their actions have consequences. But the system still considers their age and so is a bit lenient on them. Here are some of the ways the system works:

Violations of laws the juveniles commit are not referred to as crimes. But called delinquent acts.

In juvenile court, the proceeding is referred to as an adjudication hearing, not a trial, and these hearings are private, unlike those in an adult court.

If the delinquent act is non-violent, (s)he may be released before an adjudication hearing.

The form of punishment by the court on a guilty verdict is more likely to lean towards community service, supervision by a court-appointed individual or institution, paying a fine or restitution, and education, or just a stern word from the judge, but only if they have had a clean record and this is their first offense. Again, the focus of this system is to correct, rehabilitate and reorient the minor into behaving in an acceptable social manner, rather than being locked up.

Alternative Sentencing

Some states offer juvenile justice programs an alternative option for sentencing. They mostly incorporate counseling, job training, and other services that improve the mindset and values of the offender. In some cases, they are put on probation, which is the most common. The terms of probation may include curfews, educational programs, treatment programs, community service, and the list goes on. 

They are required to meet with their appointed probation officer at regular intervals to confirm that they are indeed meeting the terms of their probation. If they fail to or their guardian discovers they have violated a term of probation, and reports it as required by law, the probation officer will then file a violation of probation notice with the court. The judge will review it and determine whether to revoke the probation. A violation of probation may lead to incarceration or some other form of punishment.

Also, if the minor takes to the right path and reforms, they can have their records wiped clean or expunged after. But before then, the records of the child are sealed to keep them protected. The public does not have easy access to view them.

Disposition Order Appeal

If you are wondering what a disposition order is, it is a final order from a judge. In this case, the sentence is on the juvenile.

A juvenile has a right to appeal that order, as you may see after an adult criminal sentence. They may also ask the judge who issued the order to modify it if their situation changes. Again, similar to other adult cases, the juvenile would need to show evidence that the change would serve their best interests. 

When Does A Juvenile Get Charged As An Adult?

When that minor commits a more serious offense like a drug offense or trafficking, violent crimes or assault, being in possession or the use of arms and weaponry, murder, or other serious crimes, they can be tried and charged as an adult. Especially if they fall into any of these situations:

• If they have a prior adult charge: If a minor has had any previous criminal case transferred to the adult court, subsequent charges will also be heard in the adult court.
• If a juvenile is charged with a Class A felony, he will be charged and prosecuted as an adult. This class contains the most serious felonies, including murder, kidnapping, sexual assault, computer crime, burglary, recklessly inflicting or attempting to inflict bodily injury on another person, arson, etc.
• If a minor is 13 years old or older and has committed a felony, the judge can transfer the case to an adult criminal court. If he feels the case should be treated as more serious.

A judge can sentence a juvenile who they find has a habit of breaking the law by issuing a disposition order. They can and will sentence the juvenile to a period of incarceration; mostly short-term, but more lenient options are commonly used. 

Is Juvenile Sentencing The Same As An Adult Conviction?

Even if a juvenile is confined or imprisoned, it is mostly not the same as an adult criminal that is sentenced to prison. The minors are mostly confined under the supervision of a state-selected guardian. This could be house arrest or placement with a different relative or in a foster home. If the judge decides it will not be effective enough, they could order a juvenile to spend a short period in a juvenile detention facility, which could be followed by a period of probation.

This is generally based on the level of offense by the juvenile, if (s)he commits a more serious crime, a judge may sentence them to a longer period of incarceration in a secure juvenile facility, which could be for a year or more. Again, this depends on the level of the offense and the discretion of the judge. In some cases, though rare, a juvenile may be sentenced to a regular prison. If they are near the age of maturity when they commit a serious crime, they may begin serving their sentence in juvenile detention and then get transferred to an adult jail to complete the term once they reach a more mature age.

Youthful Offenders Law

This comes with special procedures for handling cases of minors charged for committing certain crimes in an adult criminal court. This generally begins with the case being tried in juvenile court. 

If the minor is charged with committing a felony at age 15 through 17, his or her case may or must be transferred to adult court where they determine whether the minor qualifies as a youthful offender, depending on the level of the offense.      

With a youthful offender status, the law provides confidentiality for the juvenile. A private proceeding that allows for the Records related to the minor having a higher chance of being expunged after (s)he has completed or served any required term of supervision and has no later felony convictions.

The sentencing of a youthful offender may range from the incarceration of up to four years or the maximum term sentencing for the specific crime in charitable/community service or a correctional institution for those that are under or within the age bracket of 16, paying a fine of $1,000 or more, order them to undergo treatment for drug dependency.

Can A Felon Vote?

By the nature of its private proceedings and erasure, once all requirements are met and terms served, a youthful offender status does not disqualify someone from later holding public office or forfeit your ability to receive a license granted by a public authority. Also, by law, someone who is a youthful offender is not a criminal, and being adjudged as a youthful offender is not a conviction.

Can A Felon Get A Hunting License?

It is understandable that, like other areas of life, having a record or a felony conviction on your record can affect your life in more ways than we might appreciate. 

Once you are convicted of a felony, owning or owning a firearm in most parts of the United States is illegal. 

If you should go to buy one, background checks would flag your record and that would disqualify you. But as for hunting, I’m sure you want to know since you’re reading this; Can a felon hunt or get a license to do so? Can A Felon Hunt?

Hunting with a felony conviction when you take into consideration that a majority of hunters opt for firearms or hunting rifles as their go-to weapon, clashes with laws against ex-convicted felons’ possession of firearms, but this depends on the state you find yourself in or where you plan to hunt.

For example, in Florida, a convicted felon is not allowed to own any firearms whatsoever, except if they have had their civil rights restored or the said firearm is registered and meets up the requirements of an antique firearm (that is a firearm manufactured in or before 1918; including any matchlock, flintlock, percussion cap, or similar early type of ignition system, or replica thereof). Otherwise, you are breaking the law. And even when your civil rights are restored, you still need to apply for your rights to own and possess a firearm as it is not granted back automatically.

There is also an eight-year waiting period for this process which shows you how serious this is. So, the best advice is to speak to your probation officer or research more on it to be better informed about this. The good news is there are exceptions to this rule. 

In some states, after you have completed serving your sentence, your right to own a firearm is returned, but in some cases, a specific wait period has to pass, starting from the end of your sentence. 

Louisiana is an example. It permits convicted felons to carry guns again, ten years after they end serving their sentences, provided they are not convicted of any additional felonies during the waiting period.

What Can A Felon Hunt With?

As stated above, there is an array of arsenals open to a hunter, but because a gun or hunting rifle is the quickest and most popular does not make it the only tool of the trade. There are air guns, bows, and crossbows.

If you cannot wait for the waiting period that goes with your gun rights being restored, you can use any of these other options to go hunting as a workaround. You should follow the right channels, register, and license wherever needed to make sure you do not run afoul of the law. As always, ask your probation officer, to check the laws of the state you reside in or plan to go hunting. Because one law or thing is legal in one state or on the federal level, does not automatically mean it is legal in all states.

For example, while those other hunting tools I listed earlier are legal during the hunting season, some states, like New York, do not allow convicted felons to have or use a crossbow, so doing so in their area would be considered illegal and breaking the law. Again, to be safe, you should ask your probation officer.

The Difference Between A Hunting License And A Firearms License

It is important to know that while the two may seem similar in regards to their proximity or use of firearms and guns, there are differences; a hunting license is not the same as a firearms license. 

In many states, a good example being Arkansas, those applying for a hunting license are not subject to background checks. Many states also do not need specific permits for people to hunt with guns. A few states, like Massachusetts, have laws prohibiting certain felons from hunting or requiring those interested in hunting to obtain separate permits for hunting and possessing firearms.

As stated for the most part through this article, the answer depends majorly on the state laws guiding where you reside or where you plan to go hunting. This determines the probability of you getting your hunting license, so it’s best you do a little research and ask the proper officials or personnel that work in the field.

Constructive Possession

A felony conviction has a heavy impact on one’s life, and so it is advisable that as a convicted felon, you should always be careful about being in locations where firearms are present, as this could make your life more complicated than you bargained for.

We can define constructive possession as a situation where the person knows about the firearm and is in a position of control over that firearm, or could easily have access to the firearm. In summary, you do not want to be in the company of people carrying firearms, this could give rise to a situation that could tie you to proximity to it, and raise the possibility for the argument being “what are the chances that you did not partake in the use of a said firearm”.

If you think of using or borrowing a firearm from a friend or family, this is also a legal offense, a term called a straw man purchase. It simply means buying it through a proxy, you send an individual without a conviction to purchase the firearm for your use, and if found out, they will prosecute you. So, to avoid further run-ins with the law, make sure you do your due diligence; research, inquire and ask those in relevant positions that are knowledgeable of the laws and rules so you don’t fall or trip on what could have been easily avoidable.
